The MLBPA has stones

The baseball union is filing a grievance on behalf of Shawn Chacon.

Chacon, you may remember, went all Latrell Sprewell on Astros g.m. Ed Wade, leading to Chacon being released, and his contract terminated under the "don't act like an a-hole" clause (I'm paraphrasing, of course).

The union says the termination was improper, and that the Astros need to pay Chacon the $983,607 still owed on his $2 million salary this year.

So, yeah...good luck with that...

MLBPA was talking about that immediately after it happened

i guess ed wade chewing out chacon in front of the team is an extenuating circumstance. I find it remarkable how many people in sports (or in general) think it is perfectly alright to resort to physical violence when they get into verbal altercations.

kinda OT but, out of curiousity, did the MLBPA fight lugo’s being DFA’d when he bounced his wife’s head off their bumper in the Astros parking lot?

its gotta be a crap job to defend dome of these guys, union or not.

For you lawyers...

Has Ed Wade pressed charges for assault? I have not seen anything that says he has. As such, if the Astros claim Chacon was released because he assualted Wade, wouldn’t wade have to press charges? Legally speaking, does assault only exist if charges are filed?

Wade doesn’t have to press charges if the the city/county/state has enough evidence. And Wade doesn’t have to press charges if he doesn’t want to.

What you often see is the abused wife who refuses to testify (AJM probably knows more than me since he does some family law). You can’t compel one spouse to testify against the other but you could subpoena Wade.

Term "Assault"

In their defense, can the Astros use the term “assault”, or does that carry legal specifications that is dependent upon what the city/state does with regard to Chacon choking Wade?

And the Astros will probably do all they can to win the case, so if they have to use the word battery they will (battery being the actual contact). However, just because the Astros allege a battery doesn’t mean the state/county/city has to file charges. It’s still just an allegation.

Yeah, they have to file the grievance. The owners are not known for letting small precedents of labor law slide by them without exploitation.
