OT: Driver of Adenhart's car drunk, underage

The tragic Nick Adenhart situation just gets sadder, as the Orange County Weekly has obtained autopsy reports that show that Courtney Stewart, the woman who was driving the car in which Adenhart was driving, was drunk.

However, I obtained a copy of a toxicological report this morning showing that Courtney Stewart was also driving while intoxicated, with a blood alcohol content of .16 percent, twice the legal limit assuming that Stewart, who was 20, was allowed to drink. The legal limit for underage drivers is actually .01 percent, meaning that Stewart was 16 times drunker than the law allows.

Andrew Gallo, the driver of the other car, was drunk and driving with a suspended license due to a DUI (and apparently ran a red light), but I can't imagine this helps the prosecutor's case for the strictest of punishments.

I know we've got a lot of lawyers on this blog; anyone know what this could do to the case against Gallo?

but it seems that you can almost throw the case out. driving drunk + underage seems equal to driving drunk + suspended license.

There is no way that cancells out

I’m sorry the guy had several DUI’s and a suspended license. He should not have been on the road. If you have more than 1 DUI you should be serving some time and be getting some help. It doesn’t matter who it was that died this guy should never see the light of day again. IMO

but she was driving drunk and two other people died besides her. If he is charged with murder for people dying while he was driving drunk, she is just as guilty. The fact he was more drunk shouldn’t have anything to do with it since she was twice the legal limit herself. She drove drunk, two people died. It may not have been completely her fault, but she should have never been behind the wheel. Also, I wonder if she could have avoided the accident if she would have been sober? Probably no way to know, but any chance she had of being more aware of her surroundings and avoiding the wreck went out the window with her fourth jack and coke. I am not trying to blame the victim so to speak, I just don’t see her as a victim since she was sh*t-faced as well.

It is only a matter of time

Before this guy drives drunk again and kills someone else if he is not convicted. She has already got her sentence handed to her and she paid the ultimate price.

This guy ran a red light and killed someone. You are right we will never know what would have happened if she were sober. How many of us here have driven home knowing we probably shouldn’t have. That is one thing but to do it over and over again is inexcusable, it is like playing with a loaded gun. This guy has been warned and fined out the ass he just kept making the choice to drink and drive now he should have to pay.

I think the book should have been thrown at him long before he got in this accident. Unfortunately, since she was also drunk, the case against him is may fall apart and he may end up getting a much lesser sentence, resulting in him getting back on the road and doing this again.

That makes zero sense.

So because she was drunk the case against the other drunk driver is in jeopardy?

I don’t get this logic.

And, yah, the minivan guy ran a red light then fled the scene of the accident.

She was apparently drunk, but was obeying the traffic laws at the time when this dude came across and killed them.

yea, I think this guy will definitely serve a long time in jail, but im not sure if you could convict

him of murder with that evidence, but there are so many othe laws that guy was breaking that it will be a long time b4 he says the outside world

So if I run outside start randomly shooting my gun in very direction and end up killing a dude one neighborhood over...

…but then it turns out he was doing the exact same thing in his neighborhood, they can’t convict me of murder?

He was disobeying the law, too.

But I still killed him.

I don’t see how this effects the case one single bit.

but this constant barrage on the guy just b/c hes a pro player reminds me a lot of when CNN MSNBC FOXNews all hammer us about the missing rich white girl from the suburbs for weeks and never mentions the poor black girl who has been missing for 3 times as long and lives 2 miles away.

tragic, no doubt. but FFS! how many people have died in DWI crashes since then that never get mentioned while we discuss the tragedy of a ballplayer?

i wish there was some perspective on this stuff, and i know im coming off like a cynical prick but this shit happens to multiple families every day and it gets totally ignored and no1 cares, no1 demands change, no1 says a word but then a ballplayer dies in the same way and itll never be forgotten?

Yep

While drunk driving is stupid and it is sad when anyone dies, the media coverage is different depending on who dies. A professional athlete dies and it is front page news for months and we are constantly told how sad it is. However, when Donte Stallworth drove drunk and killed someone it was reported for about 24 hours and then never mentioned again. I guess the guy Stallworth killed wasn’t popular enough to warrant coverage.

I guess it’s wrong that the ballplayer gets focus as opposed to the black girl but its not like there is some racist overtone here. If he was black, he’d still get a lot of focus. It’s just about being famous. Famous people are already in the news. Their deaths are automatically news.

anyway, it’s not like this is rehashing of old news. it’s fairly significant that the driver of his car was drunk and it is worthy of conversation.

if jon benet ransey was a black girl from compton, we woulda never heard about her. white girl from suburbs of heartland? 4+ years of coverage. that is racism imho. what i was really talking about is what uthorhfan mentions, and the stallworth or what was that cowboy who did that? they dont ever talk about the other side.

hell one NFL guy has had multiple DWI incidents involving multiple killings and he was suspended 1/2 a season or something really stupid. london fletcher? killed some1 too, future HOFer wont ever be mentioned again. Bob Hayes? not a HOFer b/c he had drug issues… this kid will goto jail forever and fletcher spends the offseason in jail. shit’s fucked.

I’ll grant you this. If she was white, but fat, ugly, and/or old, she’d get a good deal less press.

What was so intriguing about it? A woman that disappeared was last seen leaving a bar w/ a couple of guys or one other guy (depending on which story you believe). I bet that’s the case for A LOT of disappearances.

It seems to have very little to do with race, fame, or socioeconomic status, to me, except as a means to an end, which is to sell. It’s the consuming public that’s to blame, if anyone.

As much as I’d like to be, I just don’t think it’s the case.

Media coverage definitely has race bias concerning crime victims. There’s also some socioeconomic bias so sometimes it’s hard to see what’s what.

Which gets more coverage?

10 year old black girl abducted from Plano.
10 year old white girl abducted from Plano.

Which gets more coverage? On this one I can all but guarantee that the coverage would be pretty equal in the beginning, but there’d be a lot more follow up on the second story.
