The Court has set an emergency hearing on August 2 (Monday), at the request of the CRO and the Greenberg/Ryan group, to approve the pre-packaged bankruptcy plan with the revised bid by Greenberg/Ryan that the CRO has approved and is endorsing.

If the CRO signs off on it

What authority does the judge have to say no?

He's the judge

That’s all the authority he needs.

Just like, if the CRO didn’t sign off it, he could say yes.

by Adam J. Morris on Jul 30, 2010 12:20 PM CDT up reply actions

Is it a good sign for Greenberg that he's scheduled the hearing?

I.e., could this have just been dismissed without a hearing if he had wanted to?

Still a good sign

Kind of like when an ALJ signs off on something, the judge usually goes along with it. I am cautiously optimistic.

In fact, Adam, you ought to put a little plus symbol or minus symbol or up arrow or down arrow with these bankruptcy posts, so that I can just get a clear and instant indicator of whether to give a hearty “HELL YEAH” or wring my hands and gnash my teeth.

Wow

Well, it looks like there is going to be a whole round of bitching and appeals and lawsuits, but it also appears like the Judge seems to trust the CRO fully, and if the CRO sais it is fair then I guess it is… I wouldnt be surprised if it is appealed to the next district court (New Orleans right) but this is good news…

This reminds me of Marc Ganis, he said that the one way GnR could win this was if they offered the most money, or the money the lenders wanted. It appears that GnR is essentially calling the lenders bluff, taking the controversial stuff out and paying them the money they want, and now of course the lenders will cry foul because they never really meant what they said, it was all a joke, and they just enjoy being dicks so they are going to keep appealing until they run out of money.

I thought the way it was explained in the comments

If Judge Lynn approves this on the 2nd, the only way there could be a stay is if he also approves that. He wouldn’t approve the Greenberg/Ryan plan and then turn right around and grant a stay. So the only thing the other groups could do is sue for monitary damages. Is this correct?

by Tex2044 on Jul 30, 2010 12:30 PM CDT up reply actions

i guess

I don’t see Lynn giving the opposing groups a stay. They will have thier chance on Monday to make thier case for the auction to go forward.

Two theories

1. The judge is refusing to consider the motion today and will wait for the hearing on Monday. GNR probably wanted it to be heard today because we’re still before the trade deadline.

2. The judge is pissed that GNR agreed to something they should have agreed to six months ago and is going to proceed as planned.
